Wedding Photography Contract

 I/We agree to the Terms & Conditions below (required)

This agreement contains the entire understanding between Karen Buckle Photography and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and providing the document is signed by all the relevant parties.
THE CLIENT
1. We have received, read and understand the Karen Buckle Photography price list, which has been confirmed for our wedding, on payment of the deposit. We agree that payment of the initial deposit fee confirms the booking with Karen Buckle Photography as per the details shown in the booking form.
2. We agree to pay the full balance 30 days prior to the Wedding Day. Failure to do so gives Karen Buckle Photography the right to refuse to carry out the full photographic services. Monies paid are non refundable.
3. The booking of any additional costs incurred for the booking venues, photography locations etc. are our responsibility.
4. a) We are satisfied that the details outlined in the booking form are correct and will confirm the details prior to the Wedding. We agree to advise the hairdressers and make-up artists, the hire cars and the caterers of all the relevant times, details and locations as detailed here and to coordinate their services.
4. b) The details and times listed form part of this agreement and we agree to make every effort to cooperate in order for Karen Buckle Photography to fulfil its contracted photographic duty. We acknowledge Karen Buckle Photography cannot accept responsibility for the “extent” of the photographic coverage if these details are incorrect or if we chose not to follow the agreed schedule.
5. We accept the responsibility to contact Karen Buckle Photography, at least two weeks prior to the Wedding, to confirm details are correct and there are no alterations.
6. a) We agree to immediately advise Karen Buckle Photography in writing of any alterations in the details listed here including postponement or cancellation of the wedding.
6 b). In the event of cancellation of the wedding we agree that the deposit/booking fee will be forfeited. In the event that the wedding date needs to change, we agree to pay an additional $1000 which will be deducted off our final balance however will also be forfeited in the event of a cancellation.
7. The digital images provided in our private online gallery are our “negatives” and we understand that once provided to use, these are our responsibility as Karen Buckle Photography does not keep the images indefinitely. We will advise any issues with the images within 7 days of receiving them.
8. We give permission to the photographer to use any image of our Wedding for industry competitions and as required subsequent usage, and for reasonable general promotional advertising. The usage for any other purpose is to be renegotiated between the parties and requires specific permission.
9. All reasonable freight and postage which we request, will be paid by us.
10. Regarding Prints and Albums Karen Buckle Photography has no control over the environment in which the photographs are kept and that colour photographs, in common sensitised material and colour dyes, have limited life expectancy when exposed to strong and prolonged sunlight or fluorescent light sources.
Photographs will retain their colour and brilliance much longer when displayed under better lighting conditions.
11. Regarding ordering albums, we also understand that orders are to be placed and confirmed within eight weeks of viewing the proofs, otherwise prices current at the time of ordering will apply and image selection may be made by Karen Buckle Photography. We also understand that albums not finalised within 8 months of the wedding date will be forfeited.
12. Pre purchased enlargements or other products are to be ordered within 8 weeks of the wedding or will be forfeited.
13. We agree that the Copyright on all images/photographs is owned by the photographer. Karen Buckle Photography gives permission to the client to reproduce these images for personal use however prints from these images are excluded from any warranty offered by Karen Buckle Photography. Permission must be sought from Karen Buckle Photography for use of the images on any commercial basis.
Karen Buckle Photography
1. Should the nominated photographer not be available for any reason, Karen Buckle Photography will notify the Bride & Groom of the change as soon as it is known provide another photographer with equivalent skills or provide a refund, whichever is the client’s choice.
2. Although every possible care will be taken to produce photographs of all important and special events during the wedding, Karen Buckle Photography cannot place an unconditional guarantee on the above.
3. Karen Buckle Photography shall carry out this assignment with due and professional diligence. Elements beyond Karen Buckle Photography’s control include faulty materials, equipment failure, damaged and exposed film, industrial disputes, civil disturbances, or weather conditions which may inhibit or prevent Karen Buckle Photography completing in whole or in part this assignment. In this case Karen Buckle Photography shall not be liable for its complete performance of the assignment. It is agreed that the liability of Karen Buckle Photography shall be limited to a refund of any money paid under this agreement which shall be in full and final satisfaction of any damage or loss suffered.
